the "simple" adoption according to which, while
benefiting in his / her family from certain effects of the law of parentage
(name, right of succession), the adoptee nevertheless remains attached to his
biological family,
• and the so-called "plenary" adoption which replaced
the former "adoptive legitimation", according to which the adoptee
enters the family of the person adopting it by ceasing to belong to his
biological family.
Both types of adoption
Adoption currently aims to provide abandoned or orphaned children
with parents, and to provide children with couples, or even singles, who can
not get them. In addition, the Civil Code distinguishes two types of adoption:
• Plenary adoption: it gives the child a parentage that replaces
his or her parentage. Thus, the adoptee ceases to belong to his family by
blood. This type of adoption gives the child the name of the adopter (in the
case of adoption by both spouses, the name of the husband). The adoptee has in
the adopter's family the same rights and obligations as a legitimate child.
Plenary adoption firstly requires that a number of conditions be fulfilled by
both the prospective adopters and the future adopted. These are the conditions
relating to age, justice, etc. The adoption is pronounced, after instruction
and provisional placement of the child, by a judgment of the tribunal de grande
instance. The appeal is possible, but as soon as the judicial decision is
final, the full adoption is irrevocable.
• Simple adoption: it is a more rare form of adoption, which
maintains the child's ties with his family of origin. The child retains all
rights, including hereditary rights. This type of adoption confers the
adopter's name on the adoptee by adding it to the adoptee. Simple adoption is
revocable and it is also possible to turn it into full adoption throughout the
child's minority.
The wards children of the Nation can be adopted by people who
receive an approval of the departmental commission set up by the president of
the general council. The prospective adoptive parents are the object of
investigations aimed at assessing the conditions of family, educational,
financial and psychological reception. A psychiatric examination is often
requested for this purpose.
Possible educational problems
On the other hand, the
adopted child can pose educational problems if he has been changed often from a
nanny or community, or if he has been raised in a nursery. Indeed, possible
emotional deficiencies, a delay of acquisition (walking, speech) or the impossibility
of establishing stable links, may lead to serious personality disorders. As for
the revelation of adoption to the child, the majority of authors think that
there must be a way adapted to each age.
